Ainda o New York Times e a Casa Branca O presidente George W. Bush disparou forte contra o New York Times, por este ter revelado, na passada sexta-feira, a autorização presidencial para escutas telefónicas sem mandato judicial. Num discurso pronunciado ontem no Salão Oval da Casa Branca, Bush considerou a medida por si tomada, pouco tempo depois dos ataques terroristas de 11 de Setembro, um instrumento "legal e essencial" na batalha contra o terrorismo, acusando os que revelaram este caso como tendo cometido "um acto vergonhoso". Na resposta, o Times, citado pelo Editor & Publisher, justifica-se: "Let's be clear about this: illegal government spying on Americans is a violation of individual liberties, whether conditions are troubled or not. Nobody with a real regard for the rule of law and the Constitution would have difficulty seeing that. The law governing the National Security Agency was written after the Vietnam War because the government had made lists of people it considered national security threats and spied on them. All the same empty points about effective intelligence gathering were offered then, just as they are now, and the Congress, the courts and the American people rejected them." Mas o Times enfrenta igualmente a crítica daqueles que não aceitam que o jornal tenha retido uma informação de tanta relevância pública durante um ano. A explicação para este cuidado foi dada num comunicado do director, transcrito no site da CNN: "As we have done before in rare instances when faced with a convincing national security argument, we agreed not to publish at that time. We also continued reporting, and in the ensuing months two things happened that changed our thinking. First, we developed a fuller picture of the concerns and misgivings that had been expressed during the life of the program. It is not our place to pass judgment on the legal or civil liberties questions involved in such a program, but it became clear those questions loomed larger within the government than we had previously understood. Second, in the course of subsequent reporting we satisfied ourselves that we could write about this program - withholding a number of technical details - in a way that would not expose any intelligence-gathering methods or capabilities that are not already on the public record".
